A minor boy of 14 years old namely Serajul Mondal was killed by Border Security Force (B.S.F). The victim Serajul Mondol (deceased) used to live in Delhi and he came to his own village, Harharpur to celebrate Eid Festival with his family members.

It was reported by the father of the victim that on 24.12.2008 at about 11:45 p.m. at night Serajul was returning home after meeting with his mother who happened to be in Bangladesh and it is reported that on the way B.S.F. personnel killed him.

 

According to the statements of Mr. Rezaul Mondal, the father of the deceased victim that his son did not die due to firing of B.S.F. personnel as no bullet injury was apparently detected from his dead body; only three deep penetrating injuries were noticed on his chest. Had it been the case that the victim died due to assault on his chest by sharp weapon not bullet then it can be opined that the deceased was taken in to custody and then he was brutally killed by the custodians.

 

According to the statements of Assistant Commandant of Border Security Force namely Mr. Sunil Yadav that on the date of the incident 5 or 6 persons were coming from Bangladesh and B.S.F jawans wanted to stop them but those victims refused to obey their order and kept on moving. So the B.S.F Jawans fired on them and the deceased victim who was also among them died on the spot. He also made confusing statements that the body did not receive any bullet under inspection.

 

It is revealed through the fact finding report that on the night of the incident one B.S.F. Jawan of 37 No Battalion of C-Company B.S.F namely N.H. Boro (Constable no 05128115) was the person who was liable for killing of the deceased victim.

 

The police of Bagdah Police Station started an Unnatural Death case no 86/2007 and according to the statements of the Sub-Inspector namely Mr. Sadhan Kumar Ghosh of Bagdah Police Station that a specific criminal case has been started against the deceased victim, Serajul Mondal being Bagdah Police Station case no 303 (General Diary Entry no. 1661/07) dated 25/12/07 under sections 143/186/353/ 447/506/427 of the Indian Penal Code on the basis of the complaint lodged by the Assistant Commandant Mr. Sunil Yadav of 37 BD, B.S.F. against the deceased victim. The complaint related to the offences like criminal trespass, preventing the public officers to do duty and assaulting public officer, member of an unlawful assembly, criminal intimidation etc. The information furnished in the complaint lodged by BSF revealed that the body of the victim was recovered by the BSF on 24/12/2007 at about 23.45 hours in the night and handed over to the police on 25/12/2007 at about 8.45 a.m. which clearly indicates that the body of the victim was kept under their custody for several hours. The complaint further revealed the story of encounter by one BSF constable N.H. Boro who being attacked on the night of the incident by 4/5 persons, opened fire on them and on searching of the area the dead body of the victim recovered from the place of incident which was situated about 200 meters from the BOP Madhupur and approximately 250 meters from the international boundary near BP No.49/2/s. Later the unknown body was identified as the body of Serajul by local people. The complaint lodged by the BSF also alleged that on the night of the incident a wire cutter, 100 Bangladesh taka (currency) and a Daw (Sharp cutting weapon) were recovered from the place of incident. Serajul Mondal was described as aged 20 years in the complaint whereas the father of the deceased victim disclosed his age as 14. Circumstantial incidents suggest that the victim was minor.

 

The family members of the deceased victim are afraid of lodging any complaint against the guilty BSF apprehending of being tortured again in the hands of the B.S.F. jawans. The family members of the victim have not got Post Mortem report till now despite effort.
